In November 2014, Question 4, Earned Sick Time for Employees, was passed by Massachusetts voters. Barring a late change, the law will take effect on July 1, 2015. Final regulations are expected to be released in late June, giving employers less than two weeks to implement them.
The Massachusetts Earned Sick Time law applies to all employers who have employees in Massachusetts, except the federal government and cities and towns. Employers with fewer than eleven employees are not required to provide paid sick leave, but must comply with other aspects of the law.
All existing sick leave and paid time off policies should be reviewed and many will need to be amended to comply with the new law. As the Massachusetts Earned Sick Time law is complex and penalties for non-compliance can be severe, Vision Payroll strongly recommends employers consult with an attorney specializing in labor law to help ensure compliance with the law and related regulations.
